A nursing mother, Firdausi Ahmad, has approached a Shari’a Court in Kaduna State seeking the dissolution of her three-year marriage and a monthly allowance of N10,000 for the upkeep of her eight-month-old daughter.
Ahmad, who appeared before the court on Thursday through her lawyer, Malam Sani Sunusi, is seeking a divorce through Khul’i, a form of Islamic divorce initiated by a wife, with an offer to refund her N100,000 dowry.
Presenting her case, Sunusi told the court that his client had been sent back to her parents’ home by her husband, Malam Anas, who allegedly instructed her to remain there until he granted her permission to return to their matrimonial home.
The lawyer further alleged that since Ahmad left the matrimonial home, her husband had neither visited her nor checked on their eight-month-old daughter.
“My client prays the court to dissolve the marriage through Khul’i and is willing to return his dowry of N100,000,” the counsel told the court.
He also urged the court to order Anas to pay N10,000 monthly for the child’s upkeep and breastfeeding needs.
The defendant was absent from Thursday’s proceedings.
The presiding judge, Malam Yakubu Abdullahi, adjourned the case until November 11 to enable the complainant to present her witness or other evidence in support of her claims.
Abdullahi also directed the court registrar to send an invitation to the defendant and ensure his attendance at the next hearing.
The court is expected to resume proceedings on the adjourned date.
