President John Dramani Mahama has officially removed Chief Justice Gertrude Torkornoo from office, following the conclusion of a judicial inquiry that found evidence of “stated misbehaviour.”
The decision, confirmed by the presidency late Monday, marks a dramatic development in Ghana’s judicial history, making Torkornoo the first chief justice in the Fourth Republic to be dismissed from office under such circumstances.
Justice Torkornoo, who became the third woman to serve as Chief Justice in Ghana, has firmly denied any wrongdoing. In a strongly worded statement issued shortly after her dismissal, she described the process as a “politically orchestrated campaign” aimed at tarnishing her reputation and undermining the independence of the judiciary.
“This is a dark day for the rule of law in Ghana,” the former chief justice said. “My conscience is clear. I have served with integrity and impartiality throughout my judicial career.”
The specific details of the misconduct have not yet been made public, though the committee tasked with the investigation reportedly submitted a comprehensive report to the president last week. Under Ghana’s constitutional framework, the removal of a chief justice requires the recommendation of a committee appointed by the president and approved by the Judicial Council, based on evidence of stated misbehaviour, incompetence, or inability to perform the functions of office.
The dismissal has sparked widespread reaction across the political spectrum, with critics accusing the government of overreach and judicial interference, while others have welcomed the move as a step toward accountability at the highest levels of the judiciary.
Legal analysts say the implications could be far-reaching. “This sets a significant precedent,” said Dr. Ama Osei, a constitutional law expert at the University of Ghana. “Whether this will strengthen or weaken public trust in the judiciary will depend on how transparent and impartial the process is perceived to be.”
