An Area Court sitting at Centre-Igboro, Ilorin, on Tuesday, dissolved the Islamic marriage between Omolara Bekaiye and Nurudeen Olaniyan following the Wife’s testimony of lack of love, affection, and care.
The Presiding Judge, Toyin Aluko granted the dissolution of the three-year-old marriage after the husband accepted his wife’s application for divorce and custody.
Bekaiye had applied for divorce, custody, and maintenance fees of N20,000 for the two children in the marriage
She told the court that she was no longer interested in the marriage due to a lack of love, affection, and care.
The husband agreed to the divorce and custody but said that he could only pay N5,000 for maintenance, saying, “I am out of a job, and I have an aged mother to cater for.”
Aluko ruled that the mother should have custody of the two children from the marriage and the father should have unrestricted access to the children.
Delivering judgment on maintenance fees, the court said that, according to Islamic law, the father should cater to the children.
“Considering the financial capacity of the father, as well as the prevailing economic reality, we have to strike a balance between the two amounts of money prayed by the parties.
“The father should pay N10,000 monthly for maintenance of the two children, starting from November 30, through the registry of this court, for record purposes,” he said.
The court, however, said that the aggrieved party has the right to appeal to the Upper Area Court within 30 days from judgment day.
