There is more trouble ahead for embattled Rivers State Governor Siminilaye Fubara, as an Appeal Court Sitting in Abuja, the Federal Capital Territory, has ruled the passage of his government’s N800 billion 2024 budget by four members of the House of Assembly Illegal.
The Appeal Court upheld the judgement delivered by Justice James Omotosho of the Federal High Court in Abuja, on January 22, which nullified the budget as passed by the four members loyal to the governor.
A three-member Appeal Court, led by Justice Joseph Oyewole, held that Fubara’s appeal against the judgement lacked merit.
He said that Fubara lacked the right to appeal the lower court judgment having himself failed to challenge the case through his withdrawal of all processes and documents he filed against the suit.
It would be recalled that 25 lawmakers loyal to the FCT Minister, Nyesom Wike, had challenged the passage of the 2024 budget by the four lawmakers and urged the court to declared it illegal.
